Welcome to Ozone Animal Health (the “Website”). These Terms & Conditions (“Terms”) govern your use of our Website and the purchase of products from our online shop. By accessing or using our Website, you agree to be bound by these Terms. If you do not agree, you must not use our Website.

3. Products
We sell health products for animals. Some products are available for purchase by the general public, while others are restricted to verified veterinary professionals.

• General Products: Available to all registered customers.
• Vet-Only Products: Restricted to customers that have been verified as a veterinary professional. Verification requires submission of your RCVS number, practice name, and practice address. Verification is performed manually by us.
• Availability: All products are subject to availability. We will inform you as soon as possible if the products you have ordered are not available.
• Products: Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Your product may vary slightly from those images. We reserve the right to amend the specification of the product if required to conform with any applicable safety, statutory or regulatory requirements, and which do not materially affect their quality or performance. For amendments of more significant nature, we will provide the Customer with advance notice of any such significant changes and the Customer may at any time before the changes take effect cancel the order or subscription. Product packaging may vary. The packaging of the product may vary from that shown in images on our website. We reserve the right to make changes to the packaging.

4. Prices & Payment

• Prices displayed on the Website are inclusive of VAT
• Payment is currently by BACS transfer only. Full payment instructions are provided at checkout.
• Orders are dispatched once payment has been received and confirmed.

5. Orders 

• Orders will not be dispatched until payment is confirmed.
• If we are unable to accept your order, we will call or email you to advise of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.
• Refusal of Orders. The Supplier reserves the right to accept or refuse any order given on the basis of its quotation or otherwise and in the event of the refusal of any order the Supplier shall not be liable for any loss or damage arising there from or in connection therewith or in relation thereto.

6. Delivery 

• Delivery charges and timescales are outlined at checkout.(a) Unless otherwise stipulated and subject to Clause 2 (b) above all goods for delivery will be dispatched by the conveyance of  Ozone Animal Health’s choice. Where the purchaser requires a different means of conveyance any extra cost must be paid by the Purchaser.(b) Whilst every effort will be made to avoid delay no responsibility is under taken for meeting any specific delivery dates. Accordingly, no liability will be accepted for any direct or indirect loss which may be caused by delayed delivery.(c) Risk in the goods shall pass to the customer on delivery. Risk of loss and damage to goods passes to you upon delivery.
• Lost or undelivered products: In the event of a lost or undelivered products the customer must contact Ozone Animal Health via email (info@ozonevetservices.co.uk) within 28 days of the order confirmation email. Any orders reported as lost or undelivered after the given 28 day period will not be eligible for a refund or replacement.

7. Returns & Refunds

Please email us with your requirements, whether you require exchange goods or refund. (please make sure you have read the following before returning any products).

(a) Subject to (d) and (e) below, goods may be returned to Ozone Animal Health for credit or exchange for up to 14 days after the date of delivery provided that the delivery note or invoice number is quoted. Once you notify us of cancellation within that period, then you have another 14 days to return the goods.

(b) Returned goods will only be accepted by Ozone Animal Health if they are in a sound and resalable condition. Goods must be returned unused, and in the condition which they were sent out. We will not accept back soiled items, whether Goods are sound and resalable shall be at the sole decision of Ozone Animal Health. Any goods which Ozone Animal Health deems to be not resalable will only be returned to the Purchaser at the specific request of the Purchaser and at the Purchaser’s expense. Notwithstanding the discretion of Ozone Animal Health in deciding whether goods are sound and resalable, goods will not be deemed resalable if they are returned in anything but their original packaging or the quantities of the goods returned are different from those originally supplied.

(c) Where goods returned for credit or exchange are goods which have been supplied in boxes or in quantities, credit notes or exchange of goods will only be given if the goods are returned in their boxes and/or in the same quantities supplied to the Purchaser.

(d) Ozone Animal Health reserves the right to make a charge for handling and restocking equal to 20% of the sale price of the goods returned.

(e) Goods especially obtained for Ozone Animal Health may not be returned for credit or exchange.

(f ) When making a request to return products to us it should be made within the following timescales: Shortage, damaged or wrong goods: 3 working days. Faulty goods: 3 working days. Goods no longer required: 10 working days. You should always obtain a signature (i.e. proof of collection) from the collecting person.

• You may cancel your order within 14 days of receiving your goods (except for perishable or hygiene-sensitive items) under the Consumer Contracts Regulations.
• Goods must be returned unused, unopened, and in resalable condition.
• Refunds will be issued once the returned goods are received. Return postage costs are the responsibility of the customer, unless the goods were faulty or incorrectly supplied.

8. Restrictions

• Vet-only products must not be purchased or used by non-veterinary professionals.
• We reserve the right to cancel any order if vet verification cannot be confirmed.

9. Removal of Links from Our Website
If you find any link on our Website that you consider offensive for any reason, you are free to contact and inform us at any time. We will consider requests to remove links, but we are not obligated to do so or to respond directly.

10. Disclaimer
To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our Website and the use of this Website.

Nothing in this disclaimer will:

• limit or exclude our or your liability for death or personal injury;
• limit or exclude our or your liability for fraud or fraudulent misrepresentation;
• limit any of our or your liabilities in any way that is not permitted under applicable law; or
• exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer:
(a) are subject to the preceding paragraph; and
(b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, tort, and for breach of statutory duty.

As long as the Website and the information and services on the Website are provided free of charge, we will not be liable for any loss or damage of any nature.

11. Indemnity

Customers hereby undertake to indemnify and keep indemnified Ozone Animal Health its servants and agents against all costs, damages, expenses, penalties, losses and other liabilities whatsoever, including, but without prejudice to the generality of the foregoing, liability for personal injury and death, damage to property and consequential losses, incurred as a result of or arising from or in connection with or in relation to any act, omission, word or deed, whether or not negligent, of  Ozone Animal Health, its servants or agents in pursuance of the supply of products hereunder.

12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Intellectual Property Rights:

Patents, rights to inventions, copyright and related rights, trade marks, business names and domain names, rights in get-up, goodwill and the right to sue for passing off, rights in designs, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how), and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.

(a) All Intellectual Property Rights in or arising out of or in connection with the goods shall be owned by Ozone Animal Health.

(b) The customer acknowledges that, in respect of any third party Intellectual Property Rights in the goods, the customer’s use of any such Intellectual Property Rights is conditional on the customer obtaining a written license from the relevant licensor on such terms as will entitle Ozone Animal Health to license such rights to the customer.

(c) In the event that Ozone Animal Health own brands products for the Purchaser, it shall be exclusively the purchaser’s responsibility to satisfy himself that the product name(s) used on the purchaser’s products do not infringe any third party’s Intellectual Property Rights.

14. E-Commerce

(f) The products found in the Website, must not be resold via e-commerce unless approved in writing by Ozone Animal Health.

15. How we will use your personal information.

We will use the personal information you provide to us:

• to supply the products to you;
• to process your payment for the products; and
• if you agreed to this during the order process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.
